Internal Regulations

Article 1:

These regulations are established in accordance with the provisions of Articles L.6352-3 and R.6352-15 of the French Labor Code. They apply to all trainees for the duration of their training.

Article 2: Discipline 

Trainees are strictly prohibited from:

To introduce alcoholic beverages onto the premises of the organization.
To show up for training while intoxicated.
To take away or modify the training materials.
To modify the computer settings.
Eating in the classrooms.
To use their mobile phones during the sessions
Article 3: Sanctions

Any action deemed wrongful by the management of the training organization may, depending on its nature and severity, be subject to one of the following sanctions, listed in ascending order of severity:

Written warning from the Director of the training organization.
Blame.
Written warning from the Director of the training organization.
Article 4: Pre-disciplinary interview and procedure

No disciplinary action may be taken against a trainee without them being informed simultaneously and in writing of the charges against them. When the training organization is considering disciplinary action, it summons the trainee by registered letter with acknowledgment of receipt or by hand delivery against receipt, indicating the purpose of the summons, the date, time, and location of the meeting, unless the proposed disciplinary action does not affect the trainee's continued participation in the training program.

During the interview, the trainee has the option of being assisted by a person of their choice, whether a fellow trainee or an employee of the training organization.

The summons mentioned in the preceding article states this right. During the interview, the reason for the proposed sanction is explained to the trainee, who then has the opportunity to provide any explanation or justification for the alleged misconduct.

When a precautionary measure of immediate temporary exclusion is considered essential by the training organization, no final sanction relating to the wrongful conduct that led to this exclusion can be taken without the trainee having been informed beforehand of the grievances against him and, possibly, having been summoned to an interview and given the opportunity to explain himself before the disciplinary committee.

The sanction cannot be imposed less than one full day or more than 15 days after the interview or, where applicable, after consultation with the disciplinary committee.

The trainee is notified in writing, with reasons given, either by registered letter or by hand delivery against receipt. The training organization simultaneously informs the employer, and possibly the joint body responsible for covering training costs, of the sanction imposed.

Article 5: Representations of trainees

When an internship lasts more than 500 hours, a representative and an alternate representative are elected by single-member ballot with two rounds. All interns are eligible to vote and to be elected, except for prisoners admitted to participate in a vocational training program.

The training organization is organizing the election, which takes place during training hours.,

no earlier than 20 hours, and no later than 40 hours after the start of the training course. If it is impossible to appoint trainee representatives, the training organization draws up a report of failure to appoint, which it sends to the prefect of the territorially competent region.

The delegates are elected for the duration of the training. Their functions end when they cease, for whatever reason, to participate in the training.

If the appointed delegate and the alternate delegate have ceased their functions before the end of the training session, a new election shall be held under the conditions provided for in Articles R.6352-9 to R.6352-12.

Trainee representatives make suggestions to improve the organization of internships and the living conditions of trainees within the training organization. They present all individual or collective complaints relating to these matters, hygiene and safety conditions, and the application of internal regulations.

Article 6: Hygiene and safety

Preventing the risks of accidents and illnesses is imperative and requires everyone to fully comply with all applicable hygiene and safety regulations.

To this end, the general and specific safety instructions in force within the organization, where they exist, must be strictly observed under penalty of disciplinary sanctions.

When training takes place on the company's premises, the applicable general and specific safety instructions are those of the training organization.

Article 7:

 A copy of these regulations is made available to each trainee (before any final registration) or given to the trainee (before any final registration) as part of a professional training contract.
